Question: Our company signed an import contract on the DDU terms, final destination - Russia. Just before the dispatch, the shipping company hired by the seller contacted us and asked to provide it with the power of attorney to represent the interests and the right to sign contracts when receiving the goods by the shipping company in Russia. This is the first such case in our company. Up to now, all equipment was delivered to the local customs office and cleared by ourselves. We never had any interrelations with the shipping company. How can you explain this issue?
Answer: You are perfectly right to be surprised by this request, but I doubt that it comes from the shipping company. Most probably this is a business offer. The DDU Terms do not provide for customs clearance. It must be conducted by your company. However, if the shipping company’s offer is reasonable, then you might as well accept it.
